The 16th Amendment to the United States Constitution gives Congress the power to levy income taxes without basing them on population. It was ratified in 1913.
Congress passed the amendment in 1909 It was a response to the 1895 Supreme Court case Pollock v. Farmers' Loan & Trust Co. It was the first change to the Constitution since the 15th Amendment in 1870
The amendment allows the federal government to receive funding in a different way It allows Congress to tax income from any source, without apportioning it among the states
The amendment has been interpreted to mean that a tax isn't on income just because Congress says it is The amendment has also been interpreted to mean that the stockholder is to be viewed as a different entity from the corporation
Chief Justice Melville Fuller's majority opinion in Pollock held that a federal tax on income derived from property was unconstitutional when it was not apportioned among the states according to representation in the House of Representatives.
So the Supreme Court says NO UNFAIR INCOME TAX, then Congress says YES UNFAIR INCOME TAX.
SO THERE IS NO REASON FOR THE SUPREME COURT TO EXIST.
